2013 Travel Intentions Survey Official Contest Rules & Regulations
1. This Contest is governed strictly and solely by the laws of Prince Edward Island and the laws of Canada applicable in Prince Edward Island. By entering this Contest, the entrant agrees that the courts of Prince Edward Island shall have sole jurisdiction to entertain any legal proceedings. 2. The online survey must be completed before 11:59 p.m. AST on September 30, 2013, the Contest Closing Date. A random draw, by a Vision Critical representative, from all completed online surveys received as of the Contest date, will be made on November 22, 2013. Selected entrants will be contacted by e-mail/phone, as the contact information indicated on the selected entrant's survey form by a representative of Prince Edward Island Department of Tourism and Culture. If a selected entrant cannot be reached by December 6, 2013, or declines the prize, another entrant will be selected on or before December 9, 2013. In the event that a selected entrant incorrectly answers the skill testing question, another entrant will be selected on or before December 9, 2013. Only one (1) entry per person/e-mail address/household. If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s). 3. No purchase, expenditure or investment is necessary to enter this Contest. 4. Participants will be eligible to win the Prize of: four mugs and one pitcher from Right Off the Batt Pottery, each with Canadian maple leaves imprinted into the sides, four wooden coasters in holder and wooden bookmark from McAskill's Studio, one fused glass star sun-catcher from Inferno, one spoon rest and candle holder, both from Village Potter, a print titled "Colourful Buoys" by Island artist Anne Gallant, and one hand made cigar pen. All products are 100% Island made, at an approximate value of $250 (shipping costs are included). All expenses not included with the Prize, as per these rules, are the winner's responsibility. 5. Any income tax payable on the prize is the sole responsibility of the winner. 6. All prizes must be accepted as awarded. Prince Edward Island Department of Tourism and Culture reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize. The Prize has no cash value and is not transferable and no exchange for cash or other items of value is permitted. 7. In order to win, entrants must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by phone or email at a mutually convenient time. Prince Edward Island Department of Tourism and Culture judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes. 8. By entering this Contest, Contestants release Prince Edward Island Department of Tourism and Culture, Vision Critical and all affiliated persons and entities involved with the organizing of the Contest of liability and Contestants will be required to return a signed liability release and acknowledgement form in favour of all such parties before being declared a winner. Prince Edward Island Department of Tourism and Culture or their respective directors, officers or employees shall not be liable in any way for the use or any misuse of the Prize awarded in this contest. 9. By entering this Contest, each Contestant consents to the use of his/her entry, name, address and/or photograph in any publicity carried out by Prince Edward Island Department of Tourism and Culture and/or its advertising agencies, without further compensation. Winners consent to their photograph being taken by Prince Edward Island Department of Tourism and Culture for such use, without further compensation. 10. This contest is open to all residents of the United States and Canada who are 18 years of age or older, except employees of Prince Edward Island Department of Tourism and Culture (the "Contest Sponsor"), their parent and affiliate companies; their representatives and agents, the contest suppliers and those with whom they are domiciled. This includes the employees of Prince Edward Island Department of Tourism and Culture; New Brunswick Department of Tourism and Parks; Newfoundland and Labrador Department of Tourism, Culture and Recreation; Nova Scotia Department of Tourism, Culture and Heritage; Atlantic Canada Opportunities Agency; Vision Critical; any associated advertising, promotional, publicity, production or judging agencies; and members of their respective immediate families (defined as parents, children, siblings and spouse) or households, are not eligible. The contest is subject to all applicable federal, provincial and municipal laws and regulations. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties to reach a settlement. 11. No correspondence will be entered into except with the selected entrants. Prince Edward Island Department of Tourism and Culture is unaware of how many entrants there may be. The winner(s) may come from any geographic area, so long as they otherwise qualify to enter the Contest. 13. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Prince Edward Island Department of Tourism and Culture. All entries become property of the Prince Edward Island Department of Tourism and Culture who assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Prince Edward Island Department of Tourism and Culture reserves the right, in their sole discretion, to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond the reasonable control of Prince Edward Island Department of Tourism and Culture corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should an attempt be made, Prince Edward Island Department of Tourism and Culture reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 14. Prince Edward Island Department of Tourism and Culture is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the entrant, except where permission granted. This Contest will be run in accordance with these rules, subject to amendment by Prince Edward Island Department of Tourism and Culture. Contestants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest. 16. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
